By accepting or requesting services from IDY Creative Agency Pty Ltd in writing, you agree to be bound by these Terms of Service. It is not required that you explicitly read these terms prior to agreeing; however, they will be made available to you upon confirmation of any project.

3. Intellectual Property Rights
All materials provided by IDY Creative Agency Pty Ltd, including renders, pitch documents, presentations, and event project plans, remain the intellectual property of IDY Creative Agency Pty Ltd until full payment has been received, after which ownership transfers to the client unless otherwise agreed in writing.
IDY Creative Agency Pty Ltd reserves the right to showcase any artwork, ideas, sketches, or project outcomes created for clients in its portfolio as examples of work completed. This is typically, but not limited to, after the completion of the project. If you have specific secrecy, confidentiality, or NDA requirements, please clearly communicate these before agreeing to the proposal.
Should the client attempt to use, modify, alter, replicate, or unlawfully appropriate any designs or ideas without making the agreed final payment, IDY Creative Agency Pty Ltd will immediately seek legal counsel. Final payment ensures ONLY the agreed final designs become your property. Any previous concepts, ideas, or preliminary works remain the property of IDY Creative Agency Pty Ltd unless otherwise explicitly agreed upon.

5. Payment and Fees
Payments must be made according to the terms agreed upon in your project agreement. Late payments may incur additional charges as outlined in individual service agreements.

IDY Creative Agency Pty Ltd respects the confidentiality of your projects and materials. We agree not to disclose sensitive information without your explicit consent, except where legally required.
7. Liability
IDY Creative Agency Pty Ltd will not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use our services, including but not limited to loss of data, profits, or business interruption.
8. Amendments
We reserve the right to amend these Terms of Service at any time. Changes will be posted on this website and your continued use of our services constitutes acceptance of those changes.
9. Termination
We reserve the right to terminate services or restrict access at our discretion, particularly in the event of non-payment, misuse, or violation of these Terms.
